      在环境问题日益凸显的大背景下,环境公益诉讼备受关注。无论是新修订的《民事诉讼法》,还是2015年1月1日起正式实施的《环境保护法》,均首次将环境公益诉讼制度予以确认。党的十八届四中全会明确提出,应探索建立检察机关提起公益诉讼制度。2015年7月2日,经全国人大常委会授权,最高人民检察院对外公布了《检察机关提起公益诉讼试点方案》,环境公益诉讼迎来新的篇章。但是,检察机关提起环境公益诉讼虽优势明显,却任重道远,相关制度与机制仍在试点与完善之中。因此,本文就检察机关提起环境公益诉讼的理论与实践进行梳理,以对此问题做有益探索。

      In the social context of the environmental problems loom large, environmental public interest litigations have always been a major concern. Both the new revision of the Civil Procedure Law, and the new Environmental Protection Law that formally implemented on January 1, 2015, were for the first time to confirm environmental public interest litigation system. The fourth plenary session of the Party's 18th clearly put forward that we should explore to establish the system of prosecutors litigate in public's interest. On July 2, 2015, authorized by the Standing Committee of the National People's Congress, the Supreme People's Procuratorate announced “the Pilot Plan of Procuratorial Authorities on Initiating the Public Interest Litigation”, environmental public interest litigation will usher in a new chapter. Procuratorial authorities initiate the environmental public interest litigation has obvious advantages, but they also will shoulder heavy responsibilities, the related systems and mechanisms are still in perfect. Therefore, this article discussed the theory and practice of environmental public interest litigation initiated by the procuratorial authorities, and to do useful exploration on this question.
