      为遏制日益严重的塑料污染，保护全球生态环境，国际社会正在谈判制定一项具有法律约束力的塑料污染国际公约。塑料的生产限制、化学品监管、废弃物管理及多元保障机制构建是公约谈判中的关键议题与主要争议点。未来该公约的达成与实施将对中国塑料污染治理产生系统性影响，既在塑料全生命周期的上、中、下游分别对中国现有源头减量、过程控制、末端处置管理措施提出更高要求，也为治理法律规则的更新与协同明确方向。基于此，中国应当尽早布局塑料生产高端化、绿色化转型，推广塑料循环使用的经济模式与生活理念，探索构建废弃塑料回收利用闭路管理体系，统筹完善塑料污染防治的法律制度保障。

英文摘要:

      In order to curb the increasingly serious plastic pollution and protect the global ecological environment, the international community is negotiating to formulate an international convention on plastic pollution with legally binding force. Plastic production restrictions, chemical regulation, waste management, and the construction of a diversified safeguard mechanism are key issues and major points of contention in the negotiation of the convention. The future adoption and implementation of this convention will have a systematic impact on China’s plastic pollution management, which will not only put forward higher requirements on China’s existing management measures for source reduction, process control, and end-of-life disposal in the upstream, midstream and downstream of the full life cycle of plastics, but also clarify the direction for updating and synergizing the legal rules of management. Based on this, China should proactively plan for high-end and green transformation in plastic production, promote the economic models and lifestyles centered on plastic reusing, explore the construction of a closed-loop management system for waste plastic recovery and utilization, and comprehensively improve the legal system for the prevention and control of plastic pollution.
